Qualify for an Uncontested Divorce in Georgia

What clients hope to be an uncontested divorce is not always a true uncontested divorce. Simply because a divorcing couple agrees on aspects of their split and wants to reach a fair resolution, doesn’t necessarily qualify them for uncontested divorce but would lead them to be great candidates for the amicable divorce process. Working with an amicable divorce attorney is the best way to uncover the details of your case that may require additional mediation.

Requirements for uncontested divorce vary by state. Working with an attorney who specializes in low-conflict proceedings is the best way to navigate the legal system and ensure your case is filed correctly. In Georgia, there are three main criteria required to qualify for an uncontested divorce.

  • State residency: One or both individuals must have lived within Georgia for a minimum of six months.
  • Agreement on the reason for your divorce: Both parties must have agreed on the grounds for the divorce. Georgia accepts both “no-fault” and “fault” grounds, with the majority of uncontested divorces pursuing a “no-fault’ complaint.
  • Agreement on the issues in your case: Elements of a marriage will vary by each couple but decisions should be settled between the parties prior to filing and uncontested divorce. Agreements may include child custody, division of real estate and personal property, child support, and alimony payments.

Find the Right Uncontested Divorce Attorney

The appeal of uncontested divorce for many is the opportunity to avoid the courtroom and minimize conflict.
